These Terms of Service (“Terms”) govern your access to and use of the Timely online booking platform (“Timely,” “we,” “us,” or “our”), available at https://trytimely.app/ and all related services, websites, and applications. By using Timely, you agree to these Terms, our Privacy Policy, and any additional terms referenced herein. If you do not agree to these Terms, please discontinue use of Timely immediately.
1. DEFINITIONS
- “Client” means any individual or entity using Timely to offer services or manage bookings.
- “Customer” means any individual or entity booking services through Timely.
- “Account” means a registered account created to access Timely’s features.
- “Service” means the Timely platform, including all features, content, and technical resources.
- “Content” means all information, data, text, graphics, images, and other materials provided through Timely.
2. WHO CAN USE TIMELY
You must be at least 18 years old or have reached the age of majority in your jurisdiction to use Timely. By creating an Account, you represent that you have the authority to enter into these Terms. If you use Timely on behalf of an organization, you represent that you have the authority to bind that organization.
3. SERVICE AVAILABILITY
Timely is provided on an “as is” and “as available” basis. We strive to maintain 24/7 availability except during planned downtime or circumstances beyond our control (such as force majeure events). We reserve the right to modify, suspend, or discontinue any part of Timely at any time.
4. ACCOUNT REGISTRATION
To use certain features, you must create an Account and provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.
5. BOOKING, RESCHEDULING, AND CANCELLATION
Clients may offer services for booking through Timely. Customers may book, reschedule, or cancel appointments as permitted by each Client’s policies. Timely is not responsible for the content, availability, or quality of any Client’s services, nor for any refunds, rescheduling, or cancellations.
6. PAYMENTS
Timely may integrate with third-party payment processors to facilitate payments between Clients and Customers. Timely is not responsible for the processing of payments, refunds, or the accuracy of prices set by Clients. All payment-related issues must be resolved directly between Clients, Customers, and the payment processor.
7. INTELLECTUAL PROPERTY
All rights, title, and interest in and to Timely, including all content and intellectual property, are owned by Timely or its licensors. You may not copy, modify, distribute, sell, or lease any part of Timely without prior written consent.
8. ACCEPTABLE USE
You agree to use Timely only for lawful purposes and in accordance with these Terms. You may not:
- Use Timely in violation of any applicable law or regulation.
- Infringe upon the rights of others.
- Attempt to gain unauthorized access to Timely or its related systems.
- Use Timely to build a competitive product or service.
9. USER CONTENT AND DATA
You are responsible for all content you submit, upload, or transmit through Timely. By using Timely, you grant us a non-exclusive, worldwide license to use, store, and display your content solely for the purpose of providing the Service. You retain all ownership rights to your content.

Timely is provided “as is” without warranties of any kind, express or implied. We do not warrant that Timely will be uninterrupted, error-free, or secure. We disclaim all warranties, including fitness for a particular purpose and non-infringement.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Timely and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use Timely; (b) any unauthorized access to or use of our servers; (c) any interruption or cessation of the Service.
15. INDEMNIFICATION
You agree to indemnify and hold harmless Timely, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of Timely or violation of these Terms.
16. CHANGES TO TERMS
We may update these Terms at any time by posting the revised version on our website. Your continued use of Timely after changes become effective constitutes acceptance of the new Terms.
17. GOVERNING LAW
These Terms are governed by the laws of the jurisdiction in which Timely operates, without regard to conflict of law provisions.
